It would be wrong to think that, as barristers, we spend all our time appearing in courts and tribunals. A large portion of Landmark’s work is providing specialist expert legal advice. This can take the form of a written counsel’s opinion, advice by email, or orally through meeting in person, via telephone or video-conference.
Our international advisory work covers questions of public international law, points arising under contracts which apply English law, and both contentious and non-contentious matters in common law jurisdictions. This work does not normally require admission to the local bar in the jurisdiction where the client is based.
In common law jurisdictions, our advisory services can often add a valuable new perspective on difficult issues of domestic law which might be informed by common law or ECHR/EU principles and/or where the legislation in question is similarly worded to a UK statute which has been the subject of consideration in the English courts.
Our recent international advisory work includes:
- Advising a major Hong Kong landowner on compliance with environmental law.
- Advising on property law issues in the Cayman Islands.
- Advising the Attorney General of the Turks and Caicos Islands on the implications of a ruling that amendments to the Islands’ Development Manual were unlawful.
